Ma sup\u00e9rieure hi\u00e9rarchique m\u2019appelle souvent sur mon portable professionnel apr\u00e8s le travail. Est-ce qu\u2019elle a le droit de le faire ? Dois-je r\u00e9pondre \u00e0 ses appels ? <\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Est-ce qu\u2019elle a le droit de le faire ? Dois-je r\u00e9pondre \u00e0 ses appels ? Dois-je la rappeler le soir m\u00eame ?<\/strong><\/h3>\n\n\n\n<p>En Suisse, le \u00ab droit \u00e0 la d\u00e9connexion \u00bb n\u2019est pas inscrit dans la loi. Mais l\u2019employ\u00e9-e doit \u00eatre disponible et joignable en principe seulement pendant les heures de travail d\u00e9finies. Des exceptions peuvent \u00eatre convenues par contrat ou demand\u00e9es en cas d\u2019urgence. <\/p>\n\n\n\n<p>Si un employeur exige que l\u2019employ\u00e9-e soit disponible apr\u00e8s le travail sans qu\u2019un accord n\u2019ait \u00e9t\u00e9 pass\u00e9 et en dehors d\u2019une urgence, cette exigence peut \u00eatre refus\u00e9e. S\u2019il existe une obligation contractuelle d\u2019\u00eatre joignable en dehors des heures de travail pendant certaines p\u00e9riodes, cette disponibilit\u00e9 doit \u00eatre indemnis\u00e9e.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ces appels du soir peuvent durer longtemps, parfois plus de deux heures. A quelles cons\u00e9quences dois-je m\u2019attendre si je refuse de recevoir de tels appels t\u00e9l\u00e9phoniques apr\u00e8s le travail ?<\/strong><\/h3>\n\n\n\n<p>Le refus est l\u00e9gal si les conversations t\u00e9l\u00e9phoniques se d\u00e9roulent en dehors des horaires d\u00e9finis par contrat et qu\u2019il n\u2019y a pas d\u2019urgence \u2013 c\u2019est-\u00e0-dire d\u2019exception. <\/p>\n\n\n\n<p>Exige \u00e9galement que ces heures soient cr\u00e9dit\u00e9es comme temps de travail et r\u00e9mun\u00e9r\u00e9es en cons\u00e9quence, \u00e9ventuellement avec un suppl\u00e9ment pour les heures suppl\u00e9mentaires effectu\u00e9es. <\/p>\n\n\n\n<p>Si, dans des cas extr\u00eames, tu devais \u00eatre cong\u00e9di\u00e9, ce serait gravement abusif.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cette semaine, ma sup\u00e9rieure hi\u00e9rarchique m\u2019a envoy\u00e9 un courriel \u00e0 23 h. contenant les documents pour une r\u00e9union pr\u00e9vue le lendemain, afin que je puisse me pr\u00e9parer. J\u2019ai travaill\u00e9 des heures pendant la nuit. Etais-je oblig\u00e9 de le faire ?<\/strong><\/h3>\n\n\n\n<p>Conform\u00e9ment \u00e0 la loi sur le travail, le travail de nuit \u2013 c\u2019est-\u00e0-dire entre 23 heures et 6 heures \u2013 est interdit sans une autorisation. Ta sup\u00e9rieure hi\u00e9rarchique peut toutefois t\u2019envoyer un courriel apr\u00e8s 23 h. (ce qui est en tous les cas ind\u00e9cent), mais elle ne peut pas te demander de le traiter imm\u00e9diatement. <\/p>\n\n\n\n<p>Cela implique \u00e9galement la responsabilit\u00e9 personnelle des employ\u00e9-es : V\u00e9rifie tes e-mails professionnels exclusivement pendant tes heures de travail ou durant les plages horaires d\u00e9finies dans le contrat. Mais certainement pas tard dans la soir\u00e9e. Tu n\u2019es pas le CEO, ou bien ?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ma cheffe m\u2019envoie souvent un e-mail tard le soir. Dois-je toujours \u00eatre joignable et lui r\u00e9pondre imm\u00e9diatement ?<\/strong><\/h3>\n\n\n\n<p>Non, tu ne dois pas toujours \u00eatre disponible, mais uniquement pendant les horaires de travail d\u00e9finis. <\/p>\n\n\n\n<p>Si un employeur exige qu\u2019un-e employ\u00e9-e soit disponible apr\u00e8s la fin de la journ\u00e9e de travail sans accord contractuel et en dehors d\u2019urgences, cela peut \u00eatre refus\u00e9. <\/p>\n\n\n\n<p>Si les horaires de travail ne sont pas d\u00e9finis contractuellement et qu\u2019aucun horaire de pr\u00e9sence fixe dans l\u2019entreprise ou dans ton service n\u2019est \u00e0 respecter, les dispositions l\u00e9gales concernant les p\u00e9riodes de repos, le travail de nuit et les pauses doivent \u00eatre respect\u00e9es dans tous les cas. <\/p>\n\n\n\n<p>Par cons\u00e9quent, tu n\u2019es pas tenu de r\u00e9pondre \u00e0 un courriel qui arrive le jour m\u00eame apr\u00e8s le travail, sauf en cas d\u2019urgence.<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Ma sup\u00e9rieure m&rsquo;appelle souvent sur mon portable pro apr\u00e8s le boulot.
