Mais cette disposition n\u2019\u00e9voque pas explicitement les d\u00e9l\u00e9gu\u00e9s syndicaux ou les <a href=\"https:\/\/syndicom.ch\/fr\/participation-dans-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">repr\u00e9sentants \u00e9lus du personnel<\/a>. <\/li>\n\n\n\n<li>La protection des repr\u00e9sentants des travailleurs est pr\u00e9vue par la <strong><a href=\"https:\/\/syndicom.ch\/fr\/participation-dans-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur la participation<\/a><\/strong> (art. 12), dont le champ d\u2019application est plus large que celui du Code suisse des obligations (CO), mais ne comporte pas de sanctions sp\u00e9cifiques, contrairement \u00e0 ce dernier. <\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-columns has-tertiary-background-color has-background is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column has-tertiary-background-color has-background is-layout-flow wp-block-column-is-layout-flow\">\n<h3 class=\"wp-block-heading\"><strong>Licenciements abusifs<\/strong><\/h3>\n\n\n\n<p>En effet, l\u2019<strong>art. 336 CO<\/strong> \u00e9num\u00e8re, de mani\u00e8re non exhaustive, les cas de licenciements abusifs, sans en d\u00e9finir la notion. <\/p>\n\n\n\n<p>Selon la doctrine, une r\u00e9siliation est abusive lorsque les motifs sur lesquels elle se fonde sont contraires aux valeurs reconnues par la soci\u00e9t\u00e9 actuelle. <\/p>\n\n\n\n<p>Le cong\u00e9 donn\u00e9 en raison d\u2019une appartenance \u00e0 un syndicat ou de l\u2019exercice licite d\u2019une activit\u00e9 syndicale, notamment, est abusif (art. 336 al. 2 let. a. et b.). Il s\u2019agit d\u2019une disposition relativement imp\u00e9rative, c\u2019est-\u00e0-dire \u00e0 laquelle il ne peut \u00eatre d\u00e9rog\u00e9 au d\u00e9triment du travailleur.<\/p>\n<\/div>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Si je suis \u00e9lu comme <a href=\"https:\/\/syndicom.ch\/fr\/participation-dans-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">repr\u00e9sentant du personnel<\/a>, quelle sera ma marge de manoeuvre, notamment en ce qui concerne le temps n\u00e9cessaire \u00e0 ce mandat ?\u00a0<\/strong><\/h3>\n\n\n\n<p>Pour que l\u2019activit\u00e9 syndicale soit prot\u00e9g\u00e9e, il faut qu\u2019elle soit exerc\u00e9e conform\u00e9ment \u00e0 la loi et au contrat de travail (respectivement, \u00e0 une <a href=\"https:\/\/syndicom.ch\/fr\/conventions-collectives-de-travail-cct\/\" target=\"_blank\" rel=\"noreferrer noopener\">convention collective de travail (CCT)<\/a> ou un contrat-type). <\/p>\n\n\n\n<p>L\u2019employeur a en principe le droit de limiter l\u2019exercice de l\u2019activit\u00e9 syndicale par contrat, r\u00e8glement ou directives (cf. art. 321d CO) pour autant que cette limitation repose sur des motifs objectifs, tels que le souci de la bonne marche de l\u2019entreprise. Les travailleurs syndiqu\u00e9s ne b\u00e9n\u00e9ficient d\u2019aucun privil\u00e8ge particulier.<\/p>\n\n\n\n<p>Contrairement aux <a href=\"https:\/\/syndicom.ch\/fr\/participation-dans-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">repr\u00e9sentants \u00e9lus du personnel<\/a> qui, eux, peuvent exercer leur mandat durant les heures de travail, \u00e0 condition que le mandat l\u2019exige et que leurs activit\u00e9s professionnelles le permettent (art. 13 <a href=\"https:\/\/syndicom.ch\/fr\/participation-dans-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">Loi sur la participation<\/a>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dans le cas o\u00f9 je ne serais pas \u00e9lu, de quelle mani\u00e8re pourrais-je toutefois exercer mes droits syndicaux ?<\/strong><\/h3>\n\n\n\n<p>La loi ne d\u00e9finit pas quels droits syndicaux le travailleur peut exercer au sein de l\u2019entreprise. <\/p>\n\n\n\n<p>Devraient, par exemple, \u00eatre consid\u00e9r\u00e9es comme des activit\u00e9s conformes au droit, la distribution d\u2019un journal syndical pendant les pauses ou l\u2019utilisation d\u2019un local de l\u2019entreprise mis \u00e0 disposition par l\u2019employeur pour une s\u00e9ance d\u2019information en dehors des heures de travail.<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Licenciement pour avoir \u00e9t\u00e9 dans la repr\u00e9sentation des employ\u00e9-es : ce que tu dois savoir.<\/p>\n","protected":false},"featured_media":0,"template":"","meta":{"_acf_changed":false,"inline_featured_image":false,"_coblocks_attr":"","_coblocks_dimensions":"","_coblocks_responsive_height":"","_coblocks_accordion_ie_support":"","footnotes":""},"article-category":[293,299,302],"class_list":["post-3601","article","type-article","status-publish","hentry","article-category-chomage","article-category-licenciement","article-category-participation"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Droits et protection des repr\u00e9sentants du personnel - syndicom<\/title>\n<meta name=\"description\" content=\"Un membre syndicom veut s&#039;engager comme repr\u00e9sentant du personnel.
