Depuis novembre 2021, je suis la fi\u00e8re maman d\u2019une fille. Mon partenaire et moi-m\u00eame, nous nous sommes mis d\u2019accord pour endosser si possible \u00e0 parts \u00e9gales le travail r\u00e9mun\u00e9r\u00e9, les t\u00e2ches m\u00e9nag\u00e8res et les responsabilit\u00e9s familiales. Je souhaitais donc r\u00e9duire mon taux d\u2019occupation \u00e0 60 %.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Mon chef a refus\u00e9 et menac\u00e9 de me licencier. Dans le m\u00eame temps, il a autoris\u00e9 un coll\u00e8gue de travail \u00e0 r\u00e9duire son taux d\u2019occupation de 20 % pour suivre une formation continue en cours d\u2019emploi. Que puis-je faire contre la d\u00e9cision de mon chef ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019art. 3 al. 1 de la loi sur l\u2019\u00e9galit\u00e9 (LEg) interdit la discrimination des travailleuses sur le lieu de travail \u00e0 cause de leur situation familiale. Selon l\u2019art. 3 al. 2 LEg, cette interdiction s\u2019applique aussi \u00e0 l\u2019am\u00e9nagement des conditions de travail, dont fait partie la r\u00e9duction souhait\u00e9e du taux d\u2019occupation. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La discrimination d\u2019une <a href=\"https:\/\/syndicom.ch\/fr\/femmes\/\" target=\"_blank\" rel=\"noreferrer noopener\">femme<\/a> est interdite non seulement pendant la grossesse, mais aussi apr\u00e8s son retour au travail du fait qu\u2019elle est devenue m\u00e8re. Votre employeur a donc enfreint la loi sur l\u2019\u00e9galit\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Quelles cons\u00e9quences juridiques entra\u00eene l\u2019infraction \u00e0 la loi sur l\u2019\u00e9galit\u00e9 ? Comment m\u2019y prendre pour intervenir contre mon employeur ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Toute personne qui subit une discrimination au sens de l\u2019art. 3 LEg peut demander au tribunal d\u2019interdire la discrimination qu\u2019elle encourt, de faire cesser la discrimination si elle persiste ou de constater l\u2019existence de la discrimination si le trouble qu\u2019elle a cr\u00e9\u00e9 subsiste. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si votre employeur r\u00e9silie les rapports de travail parce que vous faites valoir un droit au sens de la LEg, vos chances de recevoir une indemnit\u00e9 seraient relativement bonnes. S\u2019il existe un lien entre la maternit\u00e9, l\u2019in\u00e9galit\u00e9 de traitement par rapport \u00e0 votre coll\u00e8gue masculin et le licenciement, un-e juge qualifiera tr\u00e8s probablement ce licenciement d\u2019abusif en application de l\u2019art. 5 al. 2 LEg. Attention : m\u00eame un licenciement abusif d\u00e9ploie un effet l\u00e9gal et met fin aux rapports de travail.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ma situation financi\u00e8re est actuellement tendue. Combien co\u00fbte une proc\u00e9dure judiciaire si je fais valoir que je suis victime de discrimination en raison de ma maternit\u00e9 ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La proc\u00e9dure pr\u00e9vue par la loi sur l\u2019\u00e9galit\u00e9 est gratuite. Les offices de conciliation et les tribunaux ne per\u00e7oivent pas de frais de proc\u00e9dure. En cas d\u2019une \u00e9ventuelle repr\u00e9sentation juridique, les deux parties doivent assumer des co\u00fbts. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La proc\u00e9dure judiciaire, contrairement \u00e0 la conciliation, n\u2019est pas gratuite.
