Lorsqu\u2019elle a d\u00fb fermer, je me suis inscrite aupr\u00e8s de la caisse de ch\u00f4mage. Dans un cours qu\u2019elle proposait, j\u2019ai appris \u00e0 \u00e9tablir un dossier de candidature actuel. Malgr\u00e9 de nombreuses candidatures, je ne re\u00e7ois que des refus. Je sais qu\u2019il est difficile de trouver un emploi \u00e0 mon \u00e2ge (55 ans), surtout dans ma profession. <\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Je viens de d\u00e9couvrir que beaucoup de grandes entreprises ne lisent plus elles-m\u00eames les CV, mais qu\u2019un algorithme s\u2019en charge. Est-ce que c\u2019est vrai ?<\/strong><\/h3>\n\n\n\n<p>Oui, les <a href=\"https:\/\/syndicom.ch\/fr\/intelligence-artificielle\/\" target=\"_blank\" rel=\"noreferrer noopener\">algorithmes<\/a> sont utilis\u00e9s de plus en plus souvent dans le monde du travail. En particulier lors du processus de candidature, des crit\u00e8res sont pr\u00e9d\u00e9finis (via des mots-cl\u00e9s) pour pouvoir occuper le poste vacant au mieux. Si ton CV ne remplit pas certains crit\u00e8res, ton dossier est automatiquement \u00e9cart\u00e9. Lors de la recherche d\u2019un emploi, ce processus augmente le risque de discrimination fond\u00e9e sur l\u2019\u00e2ge, le genre, la nationalit\u00e9, la situation familiale (mari\u00e9-e, enfants), etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Lors du cours de techniques de recherche d\u2019emploi, ce sujet n\u2019a pas \u00e9voqu\u00e9. Je ne sais pas d\u2019avance si c\u2019est un algorithme ou le d\u00e9partement du personnel qui examinera mon dossier, et quels crit\u00e8res sont utilis\u00e9s pour la s\u00e9lection. Est-il possible d\u2019adapter mon dossier de candidature en cons\u00e9quence et d\u2019omettre d\u2019indiquer mon \u00e2ge et ma nationalit\u00e9 ?<\/strong><\/h3>\n\n\n\n<p>Il n\u2019existe en principe aucune disposition en la mati\u00e8re. Mais ces donn\u00e9es peuvent rev\u00eatir une certaine importance pour l\u2019employeur. Les algorithmes cherchent en fonction de mots-cl\u00e9s pr\u00e9d\u00e9finis. Or s\u2019ils manquent dans les dossiers, la candidature est \u00e9limin\u00e9e. <\/p>\n\n\n\n<p>Si tu ajoutes une photo \u00e0 ton CV, l\u2019algorithme peut en d\u00e9duire ton \u00e2ge \u00e0 l\u2019aide de la reconnaissance faciale automatis\u00e9e. Ce logiciel est de plus en plus utilis\u00e9, bien que l\u2019on sache qu\u2019il ne reconna\u00eet que des st\u00e9r\u00e9otypes et n\u2019est donc pas pertinent. <\/p>\n\n\n\n<p>En fin de compte, l\u2019algorithme reprend les pr\u00e9jug\u00e9s des personnes qui d\u00e9finissent les crit\u00e8res. Et un algorithme ne reconna\u00eet que les donn\u00e9es dont il dispose. Moins il y en a, plus le processus de s\u00e9lection est subjectif.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Si cette m\u00e9thode s\u2019applique, je n\u2019ai quasiment aucune chance de trouver un emploi. L\u2019utilisation d\u2019un algorithme est pourtant discriminante. Puis-je me d\u00e9fendre en justice ?<\/strong><\/h3>\n\n\n\n<p>Conform\u00e9ment \u00e0 l\u2019article 28 du Code civil (CC), tu peux faire valoir une atteinte \u00e0 la personnalit\u00e9. Celle-ci doit avoir un caract\u00e8re illicite et elle d\u00e9pend donc de savoir si l\u2019employeur potentiel peut avancer ou non un int\u00e9r\u00eat pr\u00e9pond\u00e9rant. M\u00eame si tu es en mesure de prouver que le refus d\u00e9coule uniquement de ton \u00e2ge, tu ne peux pas pr\u00e9tendre \u00e0 un engagement. <\/p>\n\n\n\n<p>Tu as uniquement la possibilit\u00e9 d\u2019exiger une r\u00e9paration pour tort moral au sens de l\u2019art. 28a CC. N\u00e9anmoins, il n\u2019existe encore aucun arr\u00eat du Tribunal f\u00e9d\u00e9ral \u00e0 ce sujet. Pour la simple raison que l\u2019employeur n\u2019est pas tenu d\u2019indiquer le motif de son refus.
