Nous avons entendu qu\u2019\u00e0 l\u2019avenir, tous les employ\u00e9-es seront contr\u00f4l\u00e9-es r\u00e9guli\u00e8rement. <\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Est-ce que l\u2019employeur a le droit d\u2019effectuer de tels contr\u00f4les ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Selon l\u2019art. 321d CO, l\u2019employeur peut \u00e9tablir des directives sur l\u2019ex\u00e9cution du travail et donner des instructions particuli\u00e8res. Les employ\u00e9-es doivent en principe s\u2019y conformer. Les directives doivent \u00eatre en rapport avec les besoins de l\u2019entreprise et l\u2019ex\u00e9cution du contrat de travail, laquelle peut donc n\u00e9cessiter la surveillance des employ\u00e9-es. Cependant, la surveillance ou le contr\u00f4le du comportement des employ\u00e9-es \u00e0 leur poste de travail est interdit (art. 26 de l\u2019Ordonnance relative \u00e0 la loi sur le travail (OLT3). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lorsque des contr\u00f4les sont n\u00e9cessaires pour d\u2019autres raisons, ils doivent notamment \u00eatre con\u00e7us et dispos\u00e9s de fa\u00e7on \u00e0 ne pas porter atteinte \u00e0 la sant\u00e9 et \u00e0 la libert\u00e9 de mouvement des employ\u00e9-es.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vendredi dernier, en allant aux vestiaires, deux agents de s\u00e9curit\u00e9 sont venus vers moi et voulaient contr\u00f4ler ma garde-robe et mes effets personnels. Ne comprenant pas le motif, j\u2019ai refus\u00e9. Ils m\u2019ont alors indiqu\u00e9 que c\u2019\u00e9tait une nouvelle directive de l\u2019employeur. L\u2019employeur ne doit-il pas informer les employ\u00e9-es de cette nouvelle directive et les aviser avant de l\u2019appliquer ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Selon l\u2019art. 5 et l\u2019art. 6 OLT3, l\u2019employeur a l\u2019obligation d\u2019informer les employ\u00e9-es et de les consulter s\u2019il \u00e9tablit une telle directive qui porte atteinte \u00e0 la libert\u00e9 individuelle. Une telle obligation ressort \u00e9galement du principe de la bonne foi. Il doit \u00e9galement informer par qui le contr\u00f4le sera effectu\u00e9. En particulier s\u2019il a mandat\u00e9 une agence de s\u00e9curit\u00e9 priv\u00e9e.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Par la suite, les agents ont proc\u00e9d\u00e9 \u00e0 une fouille corporelle et m\u2019ont demand\u00e9 la cl\u00e9 de ma voiture priv\u00e9e parqu\u00e9e devant le b\u00e2timent. A mon avis, il s\u2019agit d\u2019une violation de ma libert\u00e9 ainsi que de ma sph\u00e8re priv\u00e9e.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">En effet, le droit de l\u2019employeur de contr\u00f4ler les employ\u00e9-es est limit\u00e9 par son obligation de prot\u00e9ger la personnalit\u00e9 de la travailleuse et du travailleur selon l\u2019art. 328 CO. Un tel contr\u00f4le doit d\u00e8s lors \u00eatre un moyen appropri\u00e9, n\u00e9cessaire et proportionn\u00e9 en vue d\u2019atteindre l\u2019objectif vis\u00e9. Les contr\u00f4les inopin\u00e9s de la garde-robe ainsi que des sacs sans le moindre soup\u00e7on de vol (pr\u00e9ventif) doivent \u00eatre r\u00e9gl\u00e9s dans <a href=\"https:\/\/syndicom.ch\/fr\/conventions-collectives-de-travail-cct\/\" target=\"_blank\" rel=\"noreferrer noopener\">une CCT<\/a>, une directive ou dans le contrat de travail individuel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> La fouille corporelle et du v\u00e9hicule priv\u00e9 violent en revanche la sph\u00e8re priv\u00e9e et ne doivent avoir lieu qu\u2019en cas de soustraction av\u00e9r\u00e9e de biens mobiliers ou de graves soup\u00e7ons d\u2019une telle infraction, et seule la police est l\u00e9gitim\u00e9e \u00e0 l\u2019ex\u00e9cuter.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Est-ce que je risque d\u2019\u00eatre licenci\u00e9 si je refuse de me soumettre \u00e0 un tel contr\u00f4le ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Si, mais le licenciement pour un tel motif serait abusif dans le sens de l\u2019art. 336a CO et tu peux pr\u00e9tendre \u00e0 une indemnit\u00e9 jusqu\u2019au montant correspondant \u00e0 six mois de salaire.
