Apr\u00e8s l\u2019ach\u00e8vement de ma formation initiale, je n\u2019ai plus accompli aucune formation. <\/p>\n\n\n\n<p class=\"is-style-lead\">Je crains aujourd\u2019hui qu\u2019elle ne soit plus suffisante par rapport \u00e0 celle de mes coll\u00e8gues plus jeunes et qu\u2019on me licencie pour cette raison.<\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Je souhaiterais donc me perfectionner. Mon employeur doit-il m\u2019accorder un tel perfectionnement ?<\/strong><\/h3>\n\n\n\n<p>Le d\u00e9veloppement professionnel doit \u00eatre reconnu comme un devoir de diligence de l\u2019employeur et \u00eatre prot\u00e9g\u00e9. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le droit au perfectionnement d\u00e9pend du contrat ou de l\u2019application d\u2019une <a href=\"https:\/\/syndicom.ch\/fr\/conventions-collectives-de-travail-cct\/\" target=\"_blank\" rel=\"noreferrer noopener\">convention collective de travail (CCT)<\/a>. <\/li>\n\n\n\n<li>La jurisprudence ne reconna\u00eet pas un droit g\u00e9n\u00e9ral au perfectionnement. <\/li>\n\n\n\n<li>De m\u00eame, la loi f\u00e9d\u00e9rale sur la formation continue est ax\u00e9e sur la responsabilit\u00e9 individuelle et renonce \u00e0 ancrer un tel droit dans la l\u00e9gislation. Elle pr\u00e9cise toutefois que les employeurs doivent \u00abfavoriser la formation continue de leurs collaborateurs\u00bb.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>J\u2019ai trouv\u00e9 une formation adapt\u00e9e \u00e0 mon d\u00e9veloppement professionnel que j\u2019aimerais pouvoir suivre. Je n\u2019ai toutefois pas les moyens de la financer moi-m\u00eame ni de l\u2019accomplir exclusivement en-dehors de mes heures de travail. Mon employeur est dispos\u00e9 \u00e0 participer aux co\u00fbts. Quelles sont les r\u00e8gles \u00e0 cet \u00e9gard?<\/strong><\/h3>\n\n\n\n<p>Seules les formations ordonn\u00e9es par l\u2019entreprise doivent \u00eatre prises en charge par l\u2019employeur. <\/p>\n\n\n\n<p>En pratique, les employeurs contribuent souvent aux frais de formation, mais pr\u00e9voient certaines contraintes. Un accord doit fixer le montant et le d\u00e9lai durant lequel l\u2019employ\u00e9-e est tenu de rembourser la formation en cas de r\u00e9siliation. <\/p>\n\n\n\n<p>Je te recommande de fixer par \u00e9crit toutes les conditions de l\u2019accord, y compris celles qui s\u2019appliquent en cas de r\u00e9siliation des rapports de travail par l\u2019employeur.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Certains modules de formation ont lieu en semaine pendant la journ\u00e9e et la formation exige d\u2019investir beaucoup de temps d\u2019\u00e9tude personnelle.\u00a0Mon employeur est-il tenu de me donner cong\u00e9 pour suivre les cours ou de m\u2019accorder du temps de travail pour \u00e9tudier ?<\/strong><\/h3>\n\n\n\n<p>Non, ici encore, seules les formations ordonn\u00e9es par l\u2019employeur doivent \u00eatre compt\u00e9es comme temps de travail r\u00e9mun\u00e9r\u00e9. <\/p>\n\n\n\n<p>Si ton employeur est dispos\u00e9 \u00e0 t\u2019accorder du temps de travail pour suivre les cours ou \u00e9tudier, cela doit \u00eatre aussi stipul\u00e9 par \u00e9crit dans l\u2019accord. A noter que l\u2019octroi de temps de travail r\u00e9tribu\u00e9 peut \u00e9galement \u00eatre li\u00e9 \u00e0 l\u2019obligation de remboursement en cas de r\u00e9siliation. <\/p>\n\n\n\n<p>D\u00e8s que tu disposeras de l\u2019accord de formation, contacte-nous.
