Ton employeur est en effet tenu de prot\u00e9ger ta personnalit\u00e9 ainsi que ta sant\u00e9. Si tu disposes d\u2019un certificat m\u00e9dical attestant une incapacit\u00e9 de travail, tu n\u2019es pas tenu-e de te rendre au travail ni de compara\u00eetre personnellement \u00e0 un entretien.<\/p>\n\n\n\n<p>Ton employeur a certes le droit de te donner des instructions particuli\u00e8res et des directives g\u00e9n\u00e9rales sur l\u2019ex\u00e9cution du travail, au sens de l\u2019art. 321d CO. Or, ce droit trouve ses limites notamment dans la protection de la personnalit\u00e9 selon l\u2019art. 328 CO. En te convoquant \u00e0 un entretien alors que tu es malade, ton employeur exerce sur toi une pression inutile, alors m\u00eame que ta sant\u00e9 est d\u00e9j\u00e0 fragile.<\/p>\n\n\n\n<p>\u00c0 noter que ni ton responsable ni les ressources humaines n\u2019ont le droit de conna\u00eetre ton diagnostic ou ton traitement m\u00e9dical. <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Selon l\u2019art. 5 let. c de la loi sur la protection des donn\u00e9es, les donn\u00e9es sur la sant\u00e9 sont consid\u00e9r\u00e9es comme des donn\u00e9es sensibles, ce qui implique qu\u2019elles ne peuvent \u00eatre trait\u00e9es qu\u2019avec le consentement expr\u00e8s de la personne concern\u00e9e. Ainsi, les seules donn\u00e9es que tu dois communiquer \u00e0 ton responsable et aux ressources humaines sont tes certificats de maladie. <\/li>\n\n\n\n<li>Au sens de l\u2019art. 321d CO, tu dois respecter le principe de la bonne foi, ce qui implique d\u2019envoyer r\u00e9guli\u00e8rement les certificats m\u00e9dicaux dans les d\u00e9lais, avant que l\u2019ancien certificat m\u00e9dical ne soit \u00e9chu, pour que ton employeur puisse notamment organiser le planning des horaires.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Mon employeur me demande de lui remettre un certificat m\u00e9dical suppl\u00e9mentaire qui atteste de mon incapacit\u00e9 \u00e0 me rendre \u00e0 cet entretien de sant\u00e9. Dois-je me rendre chez mon m\u00e9decin\u2009?<\/strong><\/h3>\n\n\n\n<p>Ton employeur ne peut pas exiger un certificat suppl\u00e9mentaire attestant l\u2019impossibilit\u00e9 pour toi de te rendre \u00e0 cet entretien. Si ton employeur a des doutes quant au bien-fond\u00e9 de ton certificat m\u00e9dical, il a la possibilit\u00e9 de faire intervenir un m\u00e9decin-conseil pour une expertise.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Est-ce que mon responsable peut me contacter r\u00e9guli\u00e8rement par t\u00e9l\u00e9phone sous pr\u00e9texte de se pr\u00e9occuper de mon \u00e9tat de sant\u00e9 ou m\u00eame me rendre visite\u2009?<\/strong><\/h3>\n\n\n\n<p>Selon l\u2019art. 321a CO, les employ\u00e9-es sont tenu-es d\u2019observer les int\u00e9r\u00eats de leur employeur. Cela implique \u00e9galement une certaine obligation de diminuer le dommage, laquelle trouve ces limites dans la protection de la personnalit\u00e9. Tu dois donc rester joignable. <\/p>\n\n\n\n<p>Mais des appels r\u00e9guliers sans motifs fond\u00e9s (p. ex.\u2009: pas de certificat m\u00e9dical, reprise pr\u00e9vue) violent l\u2019art. 328 CO. Des visites \u00e0 ton domicile ne sont pas permises et pourraient \u00eatre consid\u00e9r\u00e9es comme une violation de domicile selon l\u2019art. 186 du Code p\u00e9nal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Est-ce que mon employeur a le droit de me licencier si je ne me rends pas \u00e0 cet entretien de sant\u00e9\u2009?<\/strong><\/h3>\n\n\n\n<p>Un licenciement qui interviendrait dans ces circonstances serait consid\u00e9r\u00e9 comme abusif, en vertu de l\u2019art. 336 CO. Cet article concr\u00e9tise l\u2019interdiction g\u00e9n\u00e9rale de l\u2019abus de droit pr\u00e9vue \u00e0 l\u2019art. 2 al.2 CO. <\/p>\n\n\n\n<p>Ind\u00e9pendamment des motifs de r\u00e9siliation du contrat de travail, le licenciement peut se r\u00e9v\u00e9ler abusif lorsque l\u2019employeur n\u00e9glige son devoir de veiller \u00e0 la protection de la personnalit\u00e9 et de la sant\u00e9 de l\u2019employ\u00e9-e. <\/p>\n\n\n\n<p>Un licenciement abusif ouvre le droit au paiement d\u2019une indemnit\u00e9 pouvant aller jusqu\u2019\u00e0 six mois de salaire. Certaines <a href=\"https:\/\/syndicom.ch\/fr\/conventions-collectives-de-travail-cct\/\" target=\"_blank\" rel=\"noreferrer noopener\">conventions collectives de travail<\/a> pr\u00e9voient une indemnisation plus importante. <\/p>\n\n\n\n<p>Il est important de noter que bien qu\u2019abusif, le licenciement ne pourra pas \u00eatre remis en cause.
