{"id":4191,"date":"2021-01-01T10:09:00","date_gmt":"2021-01-01T09:09:00","guid":{"rendered":"https:\/\/projects.atxeit.ch\/syndicom\/?post_type=article&#038;p=4191"},"modified":"2025-07-29T11:31:20","modified_gmt":"2025-07-29T09:31:20","slug":"surveillance","status":"publish","type":"article","link":"https:\/\/syndicom.ch\/fr\/article-guide\/surveillance\/","title":{"rendered":"Surveillance"},"content":{"rendered":"\n<div class=\"wp-block-group alignfull has-background-color has-primary-background-color has-text-color has-background has-link-color wp-elements-834eedbda44840e1a0133eeefadb317d is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"is-style-lead\">Je travaille dans un call center et mes coll\u00e8gues et moi avons \u00e9t\u00e9 inform\u00e9s que nos conversations t\u00e9l\u00e9phoniques avec nos client-es seraient d\u00e9sormais surveill\u00e9es, soi-disant pour des raisons qualitatives. <\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong><strong>Cette surveillance est-elle l\u00e9gale ?<\/strong><\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Selon le Pr\u00e9pos\u00e9 f\u00e9d\u00e9ral \u00e0 la protection des donn\u00e9es et \u00e0 la transparence (PFPDT), l\u2019\u00e9coute ou l\u2019enregistrement des <strong>conversations professionnelles<\/strong> par l\u2019employeur ne sont l\u00e9gales que dans les buts d\u2019obtention de preuves et de contr\u00f4le de performance. <\/li>\n\n\n\n<li>Quant aux <strong>conversations priv\u00e9es<\/strong>: L\u2019employeur seul n\u2019est pas autoris\u00e9 \u00e0 les surveiller, car ce n\u2019est pas n\u00e9cessaire \u00e0 l\u2019ex\u00e9cution du contrat de travail et cela constitue une atteinte \u00e0 la personnalit\u00e9 du travailleur.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Le cas \u00e9ch\u00e9ant, des conditions sont-elles impos\u00e9es ou mon employeur est-il libre d\u2019agir comme bon lui semble ?<\/strong><\/h3>\n\n\n\n<p>Le Code p\u00e9nal pose comme condition pr\u00e9alable \u00e0 l\u2019\u00e9coute ou \u00e0 l\u2019enregistrement des conversations le consentement de tous les participants. Les personnes dont la conversation est enregistr\u00e9e ou mise sur \u00e9coute doivent en \u00eatre inform\u00e9es sans ambigu\u00eft\u00e9 (au moyen d\u2019un signal optique ou acoustique) en temps utile et doivent donner leur accord. <\/p>\n\n\n\n<p>L\u2019\u00e9coute ou l\u2019enregistrement occasionnel de conversations de tiers, c\u2019est-\u00e0-dire entre employ\u00e9-es et client-es, sont envisageables dans le cadre des <a href=\"https:\/\/syndicom.ch\/fr\/entree-glossaire\/centres-dappel-et-de-contact\/\" target=\"_blank\" rel=\"noreferrer noopener\">call centers<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cette surveillance peut-elle \u00eatre ininterrompue ou doit-elle \u00eatre limit\u00e9e dans le temps ?<\/strong><\/h3>\n\n\n\n<p>Une surveillance ininterrompue n\u2019est pas compatible avec la protection de la personnalit\u00e9, mais dans l\u2019int\u00e9r\u00eat de l\u2019employeur, notamment pour le contr\u00f4le de la qualit\u00e9, \u00e9couter et enregistrer les conversations sur une p\u00e9riode d\u00e9termin\u00e9e est permis. Les employ\u00e9-es doivent \u00eatre inform\u00e9-es \u00e0 temps et de fa\u00e7on claire sur la surveillance.
