Mon employeur est membre de l\u2019Association suisse des infrastructures de r\u00e9seau, qui a n\u00e9goci\u00e9 avec syndicom la convention collective de branche. Par cons\u00e9quent, je suis assujetti \u00e0 ladite CCT de branche. <\/p>\n\n\n\n<p class=\"is-style-lead\">Je souhaite suivre une formation continue en cours d\u2019emploi pour obtenir de meilleures qualifications pour mon poste actuel et pour \u00e9largir mes comp\u00e9tences professionnelles, personnelles et sociales. <\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group alignfull has-background-background-color has-background is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group is-style-narrow is-layout-constrained wp-block-group-is-layout-constrained\">\n<h3 class=\"wp-block-heading\"><strong>Mon employeur doit-il me soutenir financi\u00e8rement dans la formation continue\u2005?<\/strong><\/h3>\n\n\n\n<p>Tu ne peux pas obliger par voie judiciaire ton employeur \u00e0 te soutenir dans ta formation continue. Tu peux cependant argumenter, \u00e0 l\u2019aide de l\u2019art. 7.10 de la CCT branche, en faveur de la formation continue qui te donne de meilleures qualifications pour ton m\u00e9tier et qui profite donc directement \u00e0 ton employeur. Cet article invite les employeurs \u00e0 soutenir leurs employ\u00e9-es lors d\u2019une formation continue. Les employ\u00e9-es devraient notamment pouvoir se former pour maintenir leur mobilit\u00e9 professionnelle et leur employabilit\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La formation continue co\u00fbte environ 15\u2005000 francs et prend beaucoup de temps. Pendant deux ans, je devrai en effet suivre des cours sur quelque 40&nbsp;vendredis et samedis. Il est impossible que je continue \u00e0 travailler \u00e0 100\u2005% dans l\u2019entreprise pendant la formation. Que faire\u2005?<\/strong><\/h3>\n\n\n\n<p>La CCT de la branche pr\u00e9voit que le cong\u00e9 n\u00e9cessaire \u00e0 une formation continue et\/ou le soutien financier soient convenus individuellement entre l\u2019employeur et l\u2019employ\u00e9-e. Nous te recommandons de conclure avec ton employeur un accord de formation continue, qui r\u00e8gle de mani\u00e8re contraignante la participation aux co\u00fbts ainsi qu\u2019une r\u00e9duction temporaire de ton taux d\u2019occupation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Mon employeur est dispos\u00e9 \u00e0 assumer deux tiers des co\u00fbts de la formation continue et \u00e0 en convenir par \u00e9crit. La formation continue b\u00e9n\u00e9ficie aussi \u00e0 mon employeur. Ne faudrait-il donc pas que la participation aux co\u00fbts soit plus \u00e9lev\u00e9e\u2005?<\/strong><\/h3>\n\n\n\n<p>Les co\u00fbts des formations continues ordonn\u00e9es par l\u2019employeur doivent \u00eatre int\u00e9gralement pris en charge par celui-ci. Ce n\u2019est pas le cas lorsque ces formations sont souhait\u00e9es par l\u2019employ\u00e9-e ou si leur fr\u00e9quentation pendant les heures de travail a \u00e9t\u00e9 autoris\u00e9e \u00e0 la demande de l\u2019employ\u00e9-e. Les co\u00fbts sont \u00e0 la charge de l\u2019employeur uniquement si une formation est dispens\u00e9e pour les besoins de l\u2019employeur, par exemple pour l\u2019utilisation d\u2019une machine ou d\u2019un logiciel sp\u00e9cial, conform\u00e9ment \u00e0 l\u2019art. 327a al. 1 CO.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>L\u2019accord pr\u00e9voit en outre que je m\u2019engage \u00e0 travailler deux ans suppl\u00e9mentaires dans l\u2019entreprise apr\u00e8s avoir achev\u00e9 ma formation continue. Si je quitte mon poste avant, je dois rembourser une partie des co\u00fbts selon l\u2019accord pass\u00e9. Est-ce licite\u2005?<\/strong><\/h3>\n\n\n\n<p>Oui, l\u2019accord s\u2019applique dans ce cas.
